Terms of Service
To use the 8A Payments Platform for making payments, you need to understand and agree to these Terms of Service. By trying to make a payment, you agree to these Terms and acknowledge that they form a valid and enforceable agreement between you and 8A Payments.
KEY DEFINITIONS
8A Payments: Refers to 8A Payments, LLC., a company based in Georgia.
Account: Your bank or other financial account used for making or receiving payments.
Agency: Any U.S. government or public authority body.
Card: Credit or debit card from Visa®, Mastercard®, American Express®, or Discover®.
Cash Bail: Money paid to temporarily release someone from jail, ensuring they appear at future court dates.
Claim/Chargeback: A dispute you raise with your card issuer if you believe a payment was unauthorized.
Holiday: Days when U.S. banks are closed, like New Year’s Day or Christmas.
Issuer: The bank or financial institution that issued your card or payment method.
Payment Device: Your Card or other payment method supported by 8A Payments.
Recipient: The organization or entity receiving the payment.
Service: The methods 8A Payments uses to process your payment. Note that we do not provide legal advice.
Service Fee: A fee charged for using our payment service, which is disclosed before you complete your payment.
Terms: These “Terms of Service.”
Transaction: A payment made through our Service.
Unauthorized Transaction: A payment made without your permission or that you believe is fraudulent.
You/Your: The person using the Service to make a payment.
USING OUR SERVICE
Payment Methods: We only process payments using Visa®, MasterCard®, American Express®, and Discover® cards. We can't process other types of cards.
Fees: Your payment will include a non-refundable service fee. If there aren't enough funds in your account to cover both the payment and the fee, the transaction won't go through.
Authorization: We’ll only process your payment if your card issuer authorizes it.
SPECIAL TERMS FOR CASH BAIL
You are the cardholder for whom the cash bail is being paid.
By submitting your bail payment, you agree it acts as an electronic signature according to the bail laws in the relevant jurisdiction.
The bail ensures your court appearance on the scheduled date.
State law governs how cash bail is applied and whether it can be returned or forfeited.
8A Payments cannot explain bail laws or policies. For details, contact the agency or consult an attorney.
CONTACTING 8A PAYMENTS
Questions: For questions about your payment (e.g., amount, date, recipient), contact us through our website. We don’t handle questions about how the recipient uses your payment.
Privacy: Review our Privacy Policy on our website for details on how we protect your information.
FRAUD PREVENTION
We may verify your identity to prevent fraud. If we suspect your payment method isn't authorized, we might not process your transaction, even if your issuer approves it.
TRANSACTION FEES
You can cancel a transaction before it’s processed, but service fees are non-refundable.
PAYMENT HANDLING
Once we send funds to the recipient, we are not responsible for how they use or handle the payment. Contact the recipient directly for any issues.
UNAUTHORIZED TRANSACTIONS
If you suspect an unauthorized transaction, contact your card issuer immediately. They will handle the claim process, which may involve 8A Payments.
LIABILITY
Limitation: We are only responsible for making payments as authorized. We don’t guarantee the service will be error-free and are not liable for any indirect or consequential damages.
PROVIDING ACCURATE INFORMATION
You must ensure all information provided for transactions is accurate.
TRANSFER TIMING
Fund transfers typically occur within two business days, excluding weekends and holidays.
LEGAL COMPLIANCE
Use the service legally. We can block access if you violate these terms or laws. Fraudulent use of payment methods is illegal.
ARBITRATION AND LEGAL
Disputes: Any disputes must be resolved through arbitration in Atlanta, Georgia. You waive your right to a jury trial and agree to individual arbitration.
Jurisdiction: Any legal challenges related to arbitration will be heard in the U.S. District Court for the Northern District of Georgia.
ADDITIONAL TERMS
Assignment: You cannot transfer your rights or obligations to others.
Contact Info: You may need to provide an email address or mobile number.
Complete Agreement: These Terms and our Privacy Policy are the full agreement between you and 8A Payments. We can update these Terms anytime by posting them on our website. If any part is invalid, the rest still applies.
